2. Service Description

HaulCat is a technology platform that connects customers who need delivery services with independent drivers who provide those services. We facilitate the connection but are not a delivery service provider ourselves.

• HaulCat provides the platform for transactions between customers and drivers
• All delivery services are provided by independent contractors
• HaulCat does not employ drivers and is not responsible for their actions
• We facilitate payment processing and dispute resolution

3. User Accounts

3.1 Registration

To use HaulCat services, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your profile information remains accurate and up-to-date

3.2 Eligibility

You must be at least 18 years old to use HaulCat. Drivers must additionally:

• Possess a valid driver's license (for vehicle-based deliveries)
• Maintain valid vehicle insurance where required
• Have the legal right to work in your jurisdiction
• Pass any required background checks

4. Customer Terms

4.1 Creating Delivery Requests

When creating a delivery request, you agree to:

• Provide accurate pickup and delivery addresses
• Accurately describe the items to be delivered
• Ensure items comply with our prohibited items list
• Be available or have a representative available at specified times
• Pay the agreed-upon delivery fee

4.2 Prohibited Items

The following items are strictly prohibited from delivery:

• Illegal drugs, weapons, or contraband
• Hazardous materials or explosives
• Live animals (except with prior arrangement)
• Perishable items without proper packaging
• Items exceeding weight or size limitations

5. Driver Terms

5.1 Independent Contractor Status

Drivers are independent contractors, not employees of HaulCat. You are responsible for:

• Your own taxes, including self-employment tax
• Your own insurance coverage
• Vehicle maintenance and operating costs
• Compliance with all applicable laws and regulations

5.2 Accepting Deliveries

When accepting a delivery, you agree to:

• Complete the delivery in a timely manner
• Handle items with reasonable care
• Maintain professional conduct
• Follow all traffic laws and safety regulations
• Verify recipient identity when required

5.3 Earnings and Payment

HaulCat charges a 15% commission on each delivery. Payment is processed immediately upon delivery completion. You are responsible for reporting your earnings for tax purposes.

6. Payments and Fees

6.1 Customer Payments

Customers agree to pay the delivery fee displayed at the time of booking. Additional charges may apply for:

• Tips to drivers (optional)
• Cancellation fees for late cancellations
• Additional waiting time charges

6.2 Refunds

Refunds are issued at our discretion for:

• Failed deliveries due to driver fault
• Damaged items (with proof)
• Service quality issues verified by our team

7. Liability and Insurance

7.1 No Delivery Service

HaulCat provides a technology platform to connect users. We:

• DO NOT provide delivery services ourselves
• DO NOT employ, direct, or control drivers
• DO NOT handle, transport, or take custody of items
• DO NOT insure items during delivery
• DO NOT guarantee delivery outcomes

7.2 User Acknowledgments

By using HaulCat, users explicitly acknowledge and agree that:

• Drivers are independent contractors, not HaulCat employees or agents
• HaulCat does not insure items during delivery
• Users should obtain their own insurance for valuable, fragile, or important items
• HaulCat is not responsible for delays, damage, loss, or non-delivery
• All delivery agreements are directly between customers and drivers
• HaulCat's role is limited to facilitating connections and payment processing

7.3 Indemnification

Users agree to indemnify and hold HaulCat harmless from any claims, damages, or losses arising from:

• Use of the platform or services
• Items delivered through the platform
• Actions of drivers or other users
• Violation of these Terms
• Any delivery-related disputes or incidents

8. Rating and Review System

Both customers and drivers can rate each other after delivery completion. You agree to:

• Provide honest and accurate reviews
• Not post false, misleading, or defamatory reviews
• Not engage in review manipulation
• Accept that low ratings may affect your account standing

9. Account Suspension and Termination

We reserve the right to suspend or terminate accounts for:

• Violation of these Terms
• Fraudulent activity
• Consistently poor ratings
• Harassment or abusive behavior
• Delivery of prohibited items
• Non-payment or payment disputes

10. Dispute Resolution

Any disputes arising from use of HaulCat shall be resolved through:

1. Good faith negotiation between parties
2. Mediation through HaulCat's dispute resolution process
3. Binding arbitration if mediation fails

11. Intellectual Property

All content, features, and functionality of HaulCat are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our platform or content
• Use our trademarks without permission
• Reverse engineer or attempt to extract source code
• Create derivative works based on our platform

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or platform notification. Continued use after changes constitutes acceptance of modified Terms.
